What is The Legacy?
A portion of the Preserve at Deep Creek is set aside for age restricted housing, in compliance with the Housing for Older Persons Act of 1995.  At least 80% of the homes in the Legacy must have at least one resident who is age 55 or more, and no residents under the age of 19 are allowed.

Residents of the Legacy pay the same common HOA fees as everyone else, thus they have full access to all of the common areas, the main swimming pool and clubhouse, etc.  They are in every way residents of the Preserve at Deep Creek just like everyone else.  However, the Legacy has its own swimming pool, clubhouse, patio, grounds, and pickleball court that are for the exclusive use of Legacy residents and their guests.  These amenities are funded through an additional fee that is only paid by Legacy residents. 

The Legacy consists of lots 1 through 9, 106 through 182, and 473 through 591.

Residents age 65 and older can receive property tax relief, but you must meet specific criteria and apply for the relief.
 
Town of Middletown Property Tax Discount
If you are 65 years or older, and have lived in Middletown at least one year, you are eligible for a discount on your property taxes. Information is available on the town website:

Delaware School Property Tax Credit
 If you are 65 years or older you may apply for a tax credit against your school taxes of 50% with a maximum of $400. However, if you moved to Delaware after January, 2018 you are not eligible until you have resided in Delaware at least ten years. If you moved to Delaware prior to that date, you are eligible within three years. Information is available on the state website:
